Day 4: 12th July (Saturday), 2025

Design & Utility Patent Filing, Publication and Grant Process

    • Understand the difference in filing methods:

      • Design Patents: Filed under the Designs Act (India) using Form-1, supported with representational views.

      • Utility Patents: Filed under the Patents Act (India) with either a Provisional or Complete Specification using Forms 1, 2, 3, 5, and optionally 18 for early examination.

    • Learn online e-filing systems: IP India, USPTO (USA), EPO (Europe), and WIPO (PCT route).

    • Understand required documents: Drawings, Abstract, Claims, Power of Attorney, Declaration Forms, etc

    • For Utility Patents:

      • Application is automatically published after 18 months unless early publication (Form 9) is requested.

      • Examination is initiated only after Request for Examination (RFE) is filed (Form 18 or 18A).

    • For Design Patents:

      • Examination occurs immediately upon filing, and registration + publication can happen within 6–9 months if no objections arise.

    • Learn to monitor FER (First Examination Report) status and response deadlines.
